放射能問題は「人権侵害」Radiation problem is human rights volation

毎日原発事故に関するニュースが流れていますが、不思議なことに（と考えるのは私だけ？）放射能汚染拡大に関して「人権侵害だ」と訴える人権団体は、私が知っている限りいません。私が加盟している某人権団体で、そのように政策提言、あるいは声明を出したらいいのではと提案したのですが、その提案が「過激」なのか、私の説得力が弱かったのか、あるいは今回の「想定外」（この言葉は単なる言い訳に聞こえるので、使いたくないのですが）の事故と人権保障の関連生の発想がないのかよくわかりませんが、即座に応答はなく、理事会で検討したいとのことでした。

 

なぜ放射能汚染拡大を人権侵害だと言いきれるのか？

 

そもそも「人権」というと、西洋的な発想（＝日本人にはなじめない）と考える人たちが日本にいますが、それはさておき、人権をもっと身近に考えると、「抑圧された人々や弱い立場にいる人たちが自らを解放するために、持ち出した考え方」だと言えます。つまり、人権侵害とは抑圧された人々や弱い立場にいる人々が大切に扱われず、幸せになれるチャンスを奪われてしまうことを意味するのです。ですから、人権を世界人権宣言や人権法といった「知識」としてではなく、弱者を助けるための「ツール」として考えなければなりません。

 

上記を今回の事故に当てはめると、国民、特に原発半径30キロ内にいる住民が、放射能のリスクに関する「正しい」情報へのアクセスがないこと、また人間・食糧・生活・仕事・精神的な安全保障（human, food, life, work and psychological security）が脅かされていることから、人権侵害であると個人的に思います。その住民の中で最も弱い立場にいる乳幼児や妊婦は、せめて半径80キロ外への退避をだすべきです。結局それができないのは、補償の問題があるから。いつも金、金、金が優先され、人の「健康」と「安全」と「生命」はその次なんですね。

 

今までアフリカ諸国の独裁者や武装勢力の人権問題や彼らの権力の悪用をみてきましたが、今回自国・日本の国家の権力に直面し、日本もかなりの人権侵害国であることを確信しました。その国民として大変情けなく、また恥ずかしく思っています。

 

Although the nuclear plant’s problem appears on the top news every day, so far there have not been any human rights organizations which appeal this spreading contamination of radiation as “human rights’ violation.” Is it only me which considers this as bizarre? In the human rights organization, which I belong to, I suggested that we should send out a declaration as such, however, either because my suggestion was too “radical”, or others do not see the link between the radiation problem and human rights due to the “unprecedented incident” (in fact, I don’t like this word, which sounds to me as an excuse…), my suggestion was put on hold for the time being to be decided at the management level.

 

Why do I declare this spreading contamination of radiation incident as human rights violation?

 

Some Japanese tend to consider “human rights” as something Western, however, it is something more familiar or close to our daily lives. Human rights was originated from an idea “to liberate those oppressed people or those who are in weak position.” Human rights violation means that these people are not treated properly, and as a consequence, their happiness is deprived.  Therefore, instead of taking human rights merely as “knowledge” such as Universal Declaration of Human Rights or human rights law, we should rather take it as “tool” to order to assist the oppressed and weak people.

 

Let me apply this to the radiation's problem. Based on the fact that the Japanese citizens, and in particular, those residents living within a radius of 30km of the nuclear plant, don’t have any access to the “accurate” information on the radiation risk, and they are threatened from human, food, life, work and psychological security, I personally can declare that this is human rights violation. At least pregnant women and small children, who are the most vulnerable group among the residents, should evacuate outside the radius of 80km. The reason why this measure can not be taken is due to the compensation problem. As usual, it is always the money issue which is prioritized, followed by people’s safety, health and lives. 

 

I have been always looking into the human rights violation and power’s misuse by some African dictators and rebel groups, but this time, I am facing with the same issue by my country Japan, which is indeed a human rights violation country. As its national, I feel so ashamed.
